The purpose of these general Terms and conditions of sale is to define the rights and obligations of the parties with respect to remote sale of the products offered on the www.maisondete.fr website
Any placing of an order entails full agreement without reservation by the CUSTOMER to these Terms and conditions of sale. These terms and conditions may be amended. The terms and conditions applicable are those in force on the site on the date of the CUSTOMER's order.
The internet user declares that they have the legal capacity to conclude the contract, i.e. that they are legally of age.
Article 2 - Products
Any sales offer is valid for as long as the product is in the site catalogue and available.
MAISON D'ÉTÉ reserves the right to cancel or refuse the sale of any product for any legitimate reason and to inform the CUSTOMER by e-mail after the order has been placed (product unavailable, existing dispute with the CUSTOMER, abnormal demand on the part of the CUSTOMER)
Article 3 - Price
Prices are given in euros inclusive of VAT, not including processing and delivery costs except where subject to special conditions.
MAISON D'ÉTÉ reserves the right to alter its prices at any time. The prices applicable are those in force on the day of the order.
Article 4 - Orders
Any order form signed by the consumer by a « double-click » constitutes irrevocable acceptance: this may only be called into question within the limits provided for by these general Terms and conditions of sale (French Electronic Signature Act dated March 13, 2000).
The information supplied by the CUSTOMER on placement of the order commits the latter: in the event of an error in the details of the recipient, MAISON D'ÉTÉ cannot be held liable for delivery of the order being impossible, or late deliveries.
The CUSTOMER shall receive an e-mail to confirm the order, including all the essential components of the contract (products ordered, prices, delivery method, shipping costs, etc.)
Payment is by bank card, check, PayPal or bank transfer.

We accept credit cards and VISA. This is the simplest, fastest and safest option, using SOGENACTIF SOCIÉTÉ GÉNÉRALE. MAISON D'ÉTÉ has chosen a very secure payment procedure, guaranteed by SOCIÉTÉ GÉNÉRALE (3D SECURE).

The check must be received within 7 working days maximum from the date of order. If not, the order will be automatically cancelled.

Prior to any transaction, you must acknowledge that you have read the Terms and conditions of sale and expressly declare that you accept them by checking the box « By submitting this form, I accept the Terms and conditions of sale and the Privacy policy that I attest to having read ».
Purchasers have a cooling-off period of 14 days, commencing on the date of delivery of their order, to return the product to the vendor for exchange or refund (not including the cost of the return), pursuant to Article L 121-20 of the French Consumer Code.
However, the consumer has the right to return the product at any time if a hidden defect or imperfection is detected.
-VAT
French VAT of 20% is applied to all individuals whose delivery address belongs to the European Union.
It will be exempt in the following cases: professionals from the European Union, individuals and professionals from DOM-TOM (Guadeloupe/Martinique/Guyana/Mayotte/New Caledonia), Guernsey, Jersey, Canary Islands and other countries outside the European Union.
Article 5 - Delivery
The products ordered shall be delivered to the address supplied by the CUSTOMER on the order form.
Purchases paid for by bank card shall be delivered within 7 working days by Colissimo Suivi.
For any purchase paid for by check, the order shall be shipped once the payment has been confirmed by the vendor's bank, i.e. approximately 8 days after the check has been banked.
For Metropolitan France, Corsica and Monaco
The contribution to shipping costs is calculated according to the weight of the items ordered.
No shipping costs are charged for purchases of more than €150 inc. VAT.
The delivery time is generally 8 working days. The products shall be delivered to the address supplied during the order process.
The orders shall be shipped by Colissimo Suivi, enabling you to track your package on La Poste's www.colissimo.fr website.
If you are not at home at the time of delivery, La Poste will leave you a delivery notice in your mailbox, so that you can collect your package from your post office within the following 15 days.
If the products are not collected within the set time, they will be returned to MAISON D'ÉTÉ, who reserve the right to refund the products, with shipping costs charged to the CUSTOMER.
MAISON D'ÉTÉ shall make every effort to abide by the delivery times. However, late delivery grants no entitlement to compensation payments, discount or cancellation of the order.
For the European Union and rest of world
The contribution to shipping costs is calculated on the basis of the items ordered and the country of destination.
The delivery time is generally 12 working days.
Orders are shipped by Colissimo with international tracking, or Fedex.
If you are not at home at the time of delivery, the post office will leave you a delivery notice in your mailbox, so that you can collect your package from your post office within the following 15 days.
If the products are not collected within the set time, they will be returned to MAISON D'ÉTÉ, who reserve the right to refund the products, with shipping costs charged to the CUSTOMER.
MAISON D'ÉTÉ shall make every effort to abide by the delivery times. However, late delivery grants no entitlement to compensation payments, discount or cancellation of the order.
Article 6 - Security
Online card payment uses the SSL (Secure Socket Layer) protocol via the SOCIÉTÉ GÉNÉRALE Sogénactif system. The information supplied is encrypted by software and cannot be read during transit on the network. When the padlock symbol appears in your browser, this shows you that the transmission is encrypted by software. In addition, when your banking details are entered (card number, expiry date and cryptogram) the URL address becomes an https URL rather than an http address.
Article 7 - Transfer of ownership and transfer of liability
Products are shipped at the sole liability of the purchaser who may, in the event of damage, make any claims to the shipping company pursuant to the legal and regulatory conditions in force.
Article 8 - Right of withdrawal
For remote sales, pursuant to Article L 121-20 of the French Consumer Code, you have a period of 7 working days, from receipt of the order, to exercise your right of withdrawal without having to provide grounds or pay penalties, except for return shipping costs. Clients must return the products in their original condition and packaging within 15 days. The invoice must be returned with the products. The exchange or refund shall be made within 15 days of receipt of the items returned by the purchaser.
Article 9 - Protection of personal data
The vendor undertakes never to disclose the personal information of the CUSTOMER to third parties for commercial purposes.
The personal data requested from internet users are required to process and ship orders.
Processing of information supplied through the vendor's site has been declared to the CNIL French Data Protection Agency, number 1447968.
In accordance with the « Technology and Freedom » law in force and the European regulation on the protection of personal data (RGPD), you have the right to access, modify, delete and oppose the processing of personal data concerning you.

The CUSTOMER may also consult or amend their personal data in the « MY ACCOUNT » section.

Article 10 - Disputes
Claims and disputes will always meet with our full attention.
In the event of a dispute, the CUSTOMER should make a claim to MAISON D'ÉTÉ's CUSTOMER service department.

These Terms and conditions of sale are subject to French law.
In the event of a dispute, the matter shall be brought solely before the courts with jurisdiction for the city where MAISON D'ÉTÉ's registered head office is located.
Article 11 - Intellectual property
The www.maisondete.fr website owns all the intellectual property rights relating to it. By logging onto the website, internet users undertake not to copy or download all or part of its content without the express, prior permission of MAISON D'ÉTÉ.
Any reproduction in whole or in part of this content is strictly prohibited and liable to constitute the offence of copyright infringement.
Article 12 - Applicable law and language
By express agreement between the parties, this contract is governed and subject to French law.
It is written in French. In the event of it being translated into one or more other languages, the French version only shall be binding in the event of a dispute.
